By accessing or using our Services in any capacity, including booking or attending sessions, you confirm that you have read, understood, and agree to be bound by these Terms.
Overview
1.1 These Terms and Conditions ("Terms") govern your use of services provided by The
Calm Collab. Our offerings include both group and/or individual meditation and/or sound
frequency sessions. Our services aim to support the holistic wellbeing for a variety of
audiences including, the general public, workplaces/organisations, emergency service
personnel, healthcare professionals, students and other professionals, as well as
one-on-one sessions ("Services").
1.2 By booking or attending any of The Calm Collab’s Services, you agree to these Terms,
which may be updated from time to time without prior notice and any such updates will take
effect upon publication. Continued use of our Services after changes are made constitutes
your acceptance of the revised Terms.
Booking and Payment
2.1 Public casual group sessions must be booked via Eventbrite. Please review
Eventbrite’s Terms and Conditions regarding cancellations and refunds.
2.2 One-on-one sessions, workplace/organisation sessions and other private
bookings will be invoiced.
2.3 Failure to pay an invoice on time may incur an administrative fee, cancellation of the
session or refusal of future bookings until payment is made.
2.4.0 One-on-one Sessions
Booking & Payment
To confirm your session, an invoice will be issued and full payment is required at the time of
booking. Payment can be made via bank transfer.
Cancellations
● 72 hours notice or more: Your request must be in writing. You may reschedule your
session or receive a full refund.
● Less than 72 hours notice: Your request must be in writing. No refunds will be
issued.
● No-shows: Sessions missed without notice are non-refundable and cannot be
rescheduled.
Lateness
● Sessions begin and end at the scheduled time, based on the practitioner’s arrival. If
the client is not ready or is delayed, the session will still end at the originally agreed
time.
● If the client is more than 15 minutes late or unavailable upon arrival, the session may
be treated as a no-show and cancelled without refund.
2.4.1 Workplace or Corporate Sessions
Booking & Payment
To confirm your session, an invoice will be issued. Payment can be made via bank transfer.
● For bookings made more than 14 days in advance, a 50% non-refundable deposit is
required at the time of booking. The remaining 50% balance is due at least 14 days
prior to the session date.
● For bookings made less than 14 days before the session, full payment (100%) is
due upon confirmation.
Cancellations
● 14 days notice or more: Any payments made (excluding the non-refundable
deposit) will be refunded in full.
● Less than 14 days notice: The full session fee is non-refundable.
Lateness
● Sessions begin and end at the scheduled time, based on the practitioner’s arrival. If
the client is not ready or is delayed, the session will still end at the originally agreed
time.
● If the client is more than 15 minutes late or unavailable upon arrival, the session may
be treated as a no-show and cancelled without refund.
Rescheduling
● One rescheduling request may be accommodated without penalty if made more than
14 days before the scheduled session.
● Rescheduling requests made within 14 days of the session may incur a 25%
administrative fee or may not be accepted, subject to availability.
● Rescheduling is subject to the practitioner’s schedule and cannot be guaranteed.
2.4.2 General Terms
● All bookings are non-transferable unless otherwise agreed in writing.
● In the rare event the practitioner must cancel (due to emergencies, illness, or low
attendance) clients will be offered either a full refund or a rescheduled session at no
extra cost.
● Any third-party costs (e.g., venue hire, travel, accommodation) already incurred by
the practitioner at the time of cancellation or rescheduling will remain payable and
are non-refundable.
● Please arrive at least 10 minutes early for all sessions. Late entry may not be
permitted once a session begins.
● By making a booking, the client confirms acceptance of these terms.
Disclaimers and Health
3.1 Meditation and sound frequency sessions are offered as complementary holistic
practices intended to promote relaxation, wellbeing, and support preventative care.
3.2 Individual responses to these practices may vary; results are not guaranteed and may
differ from person to person. Results may not be immediate or consistent.
3.3 Some participants may experience unexpected emotional or physical sensations during
or after sessions. It is important to approach these experiences with openness and
communicate any concerns to the facilitator.
3.4 These holistic practices do not replace professional medical treatment or advice. The
Calm Collab does not diagnose or prescribe.
3.5 Services and sessions provided by The Calm Collabs are not a substitute for
professional counselling, psychological treatment, or occupational health services. They are
designed to support wellbeing in a preventative and complementary capacity only. If needed,
we may recommend you seek support or referral from a qualified healthcare professional.
3.6 Participants are responsible for disclosing any health conditions that may impact their
ability to safely participate in our sessions, contraindications are listed below:
● Epilepsy or seizures
● Pacemakers or other electronic medical implants
● Tinnitus or sound sensitivity
● Severe mental health conditions (e.g. schizophrenia, psychosis or severe
anxiety/depression)
● Pregnancy
● Recent surgeries or injuries
3.7 By attending, you agree that you are physically and psychologically able to participate,
and accept full responsibility for any outcomes.
3.8 If you have any physical or psychological health concerns, medical conditions, or are
uncertain, please consult your healthcare provider before attending.
Use of the Website and Social Media
4.1 By using The Calm Collab’s website and social media, you agree to comply with all
applicable laws and not use the site for fraudulent, unlawful, or harmful activities.
4.2 You must not interfere with or compromise the security or operation of the website or
social media, nor submit content that is defamatory, offensive, illegal, or infringes on others
rights.
4.3 We do not guarantee uninterrupted or error-free access to the website or social media
and are not liable for any losses arising from website and social media use.
Privacy and Data Collection
5.1 The Calm Collab respects your privacy and is committed to protecting your personal
information in accordance with the Privacy Act 1988 (Cth).
5.2 Personal information is collected to provide and improve our services, process
payments, communicate with you, and comply with legal obligations.
5.3 We collect information you provide directly (e.g. contact details, payment information,
health disclaimers) and automatically through website logs, including IP addresses and
cookies.
5.4 Cookies help us recognise repeat visitors and understand website usage. You may
disable cookies in your browser, but this may limit functionality.
5.5 Personal data is retained only as long as necessary to fulfill the purpose for which it was
collected or as required by law.
5.6 Your information may be shared with third parties only as necessary to provide services
(e.g. payment processors) or to provide ongoing care and/or safety to yourself or others (e.g.
referral to a healthcare provider or emergency services) or when required by law.
5.7 You have the right to request access to, correction of, or deletion of your personal
information.
Marketing and Use of Content
6.1 You may receive marketing communications about The Calm Collab’s Services. You can
opt out at any time by contacting us via email.
6.2 Photos, images, or other media used in our marketing materials (website and social
media) may be sourced and/or created through digital means and is for promotional
purposes only which may not reflect individual experiences.
6.3 Testimonials or feedback may be used for promotional purposes only with your consent.
Intellectual Property
7.1 All content created by The Calm Collab (excluding photos, images or other media used
in our marketing materials that have been sourced or created through digital means), is the
intellectual property of The Calm Collab or its licensors. This includes, but is not limited to
content shared via social media, on our website and in materials provided pre, during or post
sessions.
7.2 You may not copy, reproduce, or distribute our content without written permission.
Conduct and Safety
8.1 Participants agree to behave respectfully and refrain from any conduct that is harmful,
discriminatory, or disruptive.
8.2 The use of mobile phones or electronic devices during sessions should be minimal or as
instructed to maintain a peaceful environment for all participants.
8.3 We encourage you to bring your own comfortable items such as mats, cushions, or
blankets for your comfort during sessions. The Calm Collab is not responsible for lost or
damaged personal belongings.
Session Modifications
9.1 Session content, instruments, and format may vary depending on group needs, venue
requirements, or facilitator discretion.
9.2 Sound frequency tools used may include (but are not limited to) crystal singing bowls,
tuning forks, koshi chimes, voice work and other instruments selected at facilitator discretion.
Emergency and Referral
10.1 In the event of an emergency or if your wellbeing requires it, we reserve the right to
cease services and refer you to and/or recommend you to an appropriate healthcare
professional.
10.2 Participants are encouraged to seek appropriate medical or psychological care outside
of sessions if required.
Liability
11.1 To the extent permitted by law, The Calm Collab is not responsible for any loss, injury,
or damage you may experience as a result of participating in our Services. By taking part in
our services, you acknowledge that you do so voluntarily and at your own risk.
11.2 Our total liability is limited to the amount paid by you for the Services.
11.3 We do not accept responsibility for any indirect or consequential losses.
Australian Consumer Law
12.1 Our Services come with guarantees that cannot be excluded under the Australian
Consumer Law.
12.2 You are entitled to a refund, replacement, or compensation for major failures and have
rights to have services re-performed if of unacceptable quality.
Force Majeure
13.1 The Calm Collab is not liable for any failure or delay in delivering Services caused by
circumstances beyond our reasonable control, including but not limited to natural disasters,
government restrictions, or technical failures.
Accessibility and Inclusion
14.1 The Calm Collab is committed to providing accessible and inclusive Services. Please
contact us prior to booking if you have any specific needs or require accommodations.
Children and Minors
15.1 Unless otherwise stated, sessions are intended for adults aged 18 and over.
15.2 Children or minors may only attend specific sessions with prior written permission and
must be accompanied by a parent or legal guardian at all times.
15.3 The facilitator reserves the right to deny entry to any minor not previously approved for
attendance.
Complaints
16.1 If you have any concerns or complaints about our services or privacy practices, please
contact us at info@thecalmcollab.com.au. We aim to respond within 7 business days.
Feedback and Testimonials
17.1 We welcome your feedback and testimonials. By providing a testimonial, you grant The
Calm Collab permission to use it for marketing and promotional purposes.
Website Use and Content
18.1 We reserve the right to change the content or format of our website without notice.
18.2 We are not responsible for content on third-party websites linked from our site and/or
social media. Use such links at your own risk.
Entire Agreement
19.1 These Terms, along with any other incorporated documents, form the entire agreement
between you and The Calm Collab regarding our services.
19.2 If any provision of these Terms is determined to be unenforceable or invalid, that
provision shall be modified or severed to the minimum extent necessary, without affecting
the validity and enforceability of the remaining provisions.
19.3 Failure to enforce any part of these Terms does not waive our rights.
